Waiver Policy
Participation, Assumption of Risk and Liability
1. Participation at Own Risk
By registering for or attending any event organised by 19th Hole Golf Group Ltd trading as 19th Hole Syndicate (“the Society”), participants acknowledge that golf and related social or sporting activities involve inherent and obvious risks, including (without limitation):
-
slips, trips and falls
-
injury caused by golf balls, clubs, golf carts or course conditions
-
weather-related hazards
-
travel-related risks associated with attending events
-
loss of or damage to personal belongings
Participation in Society events is voluntary and undertaken at each participant’s own risk.
2. Participant Responsibilities
Participants agree they are responsible for:
-
ensuring they are physically and medically fit to participate;
-
assessing for themselves whether conditions are safe for them to play;
-
exercising reasonable care, judgment and personal responsibility at all times;
-
complying with all golf course rules, local rules, venue policies and instructions from course or venue staff;
-
using equipment safely and responsibly;
-
behaving in a manner that does not endanger themselves or others.
Participants remain responsible for injury, loss or damage caused by their own acts, omissions, negligence or misconduct.
3. Personal Property
Participants are responsible for their own equipment, valuables and personal property.
The Society accepts no responsibility for theft, loss or damage to personal belongings brought to or used at events, except where such liability cannot lawfully be excluded.
4. Limitation of Liability
To the fullest extent permitted by law, the Society shall not be liable for losses, damage, costs or expenses arising from participation in Society events except where caused by the Society’s negligence or where liability cannot legally be excluded or limited.
Nothing in these terms excludes or limits liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation;
-
any liability that cannot lawfully be excluded or restricted under applicable law.
For losses other than death or personal injury caused by negligence, any limitation of liability is subject to applicable law and any requirement of reasonableness.
5. Third-Party Venues and Providers
Many events take place at third-party golf courses or venues operated independently from the Society. Participants acknowledge that:

golf courses and venues remain responsible for the safety and operation of their own premises and services;

the Society is not responsible for acts, omissions or failures of third-party venues or providers, except to the extent liability cannot legally be excluded.

6. Insurance
Participants are encouraged to ensure they have appropriate personal insurance cover (including health, accident, travel or equipment cover where relevant).
7. Acceptance of Terms
By entering or participating in a Society event, participants confirm they have read, understood and accepted these terms and acknowledge the inherent risks of participation.
